These Terms and Conditions govern your use of homegrownhemp.com.au and any purchase made through the website.

Homegrown Hemp is operated by HOME GROWN HEMP PTY LTD (ABN 25 681 367 493), an Australian proprietary company registered in New South Wales.

In these Terms and Conditions, “Homegrown Hemp”, “we”, “us” and “our” refer to HOME GROWN HEMP PTY LTD. “You” and “your” refer to a website visitor or customer.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order through our website.

By placing an order, you confirm that:

You are at least 18 years old
The information you provide is accurate and complete
You are authorised to use the selected payment method
You are purchasing the products for lawful purposes
You will use the products in accordance with their labels and directions

We may cancel or refuse an order if we reasonably believe these requirements have not been satisfied.

2. Product Classification and Intended Use

Homegrown Hemp oils sold through this website are labelled for topical use only.

They are not food, beverages or products intended for oral consumption. Do not swallow or ingest them.

Unless a product is expressly identified as a therapeutic good included in the Australian Register of Therapeutic Goods, our products are not presented as medicines and are not intended to diagnose, treat, cure or prevent any disease, injury or medical condition.

Information provided on our website is general product information. It is not medical advice and should not be used as a substitute for advice from a qualified healthcare professional.

3. Product Information

We take reasonable care to ensure that product descriptions, ingredients, strengths, sizes, photographs, prices and availability are accurate.

However:

Colours may appear differently depending on your screen
Packaging may be updated from time to time
Natural ingredients may vary slightly between batches
Product colour, aroma, texture or appearance may vary naturally
Minor packaging variations may occur without changing the product itself

Natural variation does not necessarily mean that a product is faulty.

If information on the website conflicts with mandatory safety or usage information printed on the physical product, stop using the product and contact us for clarification.

We reserve the right to correct genuine website errors. If an error materially affects an order you have placed, we will contact you and provide an appropriate option, which may include confirming the corrected order or receiving a refund.

4. Safe Product Use

Unless the label states otherwise:

Do not swallow or ingest the product
Avoid contact with the eyes, mouth and other sensitive areas
Do not apply the product to broken, damaged or irritated skin

Stop using the product if irritation, redness, swelling or discomfort occurs
Keep the product out of reach of children and pets
Store the product as directed on its packaging

Seek appropriate medical assistance if an adverse reaction is serious or persists.

Consult a qualified healthcare professional before use if you are pregnant, breastfeeding, taking medication, have allergies or a medical condition, or are uncertain whether the product is suitable for you.

5. Orders

An order submitted through the website is an offer to purchase products under these terms.

An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that the order has been accepted.

We accept an order when:

We send confirmation that the order has been accepted or dispatched, or
We otherwise expressly confirm acceptance

We may decline or cancel an order before dispatch where reasonably necessary, including because of:

Product unavailability
An obvious pricing or description error
Incorrect or incomplete customer information
Suspected fraud or unauthorised payment
A delivery restriction

If we cancel an order after receiving payment, we will refund the amount paid using the original payment method unless another method is agreed with you.

6. Prices and Payment

All prices displayed on our website are in Australian dollars unless expressly stated otherwise.

Prices include applicable taxes where required. Delivery charges and other applicable costs will be displayed before you submit your order.

We may update prices at any time. A price change will not affect an order that we have already accepted, except where correcting an obvious error and subject to your rights under Australian law.

We generally do not receive or store your complete payment-card details.

If a payment is declined, reversed or identified as potentially unauthorised, we may suspend or cancel the order while the matter is reviewed.

7. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions displayed with the offer.

Unless otherwise stated:

A discount code may be used once per eligible customer or order
Discount codes cannot be exchanged for cash
Discount codes cannot be applied retrospectively
Multiple offers cannot be combined
Discounts do not apply to delivery charges
Offers remain subject to product availability

We may withdraw or correct a promotion where it contains an obvious error, has been misused or is affected by fraud. This does not limit any rights you may have under the Australian Consumer Law.

8. Product Availability and Purchase Limits

All products are subject to availability.

Adding a product to your cart does not reserve it. A product may become unavailable before checkout is completed or before an order is accepted.

We may apply reasonable purchase limits to support fair availability, prevent unauthorised resale or respond to supply constraints.

We will not substitute a materially different product without your agreement.

9. Shipping and Delivery

You must provide a complete and accurate delivery address, email address and telephone number.

Available shipping methods, costs and estimated delivery times will be displayed at checkout or explained in our Shipping Policy.

Delivery timeframes are estimates unless we expressly agree otherwise. Delivery may be affected by carrier delays, remote locations, severe weather, public holidays, natural disasters or other circumstances outside our reasonable control.

You entered an incorrect delivery address
Your parcel has not arrived within a reasonable period
Tracking shows an unexpected delivery issue
Your parcel arrives damaged
An item is missing or incorrect

If you authorise a delivery provider to leave a parcel unattended, consider whether the location is secure and protected from heat, weather, children and pets.

Nothing in this section limits your rights under the Australian Consumer Law.

10. Returns, Refunds and Consumer Guarantees

Returns, replacements and refunds are handled in accordance with our Returns and Refund Policy and the Australian Consumer Law.

Our products come with consumer guarantees that cannot be excluded.

If a product has a major failure, you may be entitled to choose a refund or replacement and may also be entitled to compensation for other reasonably foreseeable loss or damage.

If a product has a minor problem, we may choose to provide an appropriate remedy within a reasonable time.

Change-of-mind returns are subject to the eligibility requirements stated in our Returns and Refund Policy.

11. Customer Accounts

You may be able to create an account to manage orders and customer information.

You are responsible for:

You grant Homegrown Hemp a non-exclusive, worldwide, royalty-free licence to store, reproduce, display and use the submitted content in connection with operating and promoting the business.

We may moderate or remove content that is unlawful, misleading, abusive, irrelevant, fraudulent or inconsistent with these terms. We will not materially alter a customer review in a way that misrepresents the reviewer’s genuine opinion.

13. Intellectual Property

The website and its original content—including branding, logos, text, photographs, graphics, packaging artwork and website design—are owned by or licensed to Homegrown Hemp and are protected by applicable intellectual-property laws.

You may view and print website content for personal, non-commercial use.

Without our written permission, you must not:

Modify or create derivative works from our branding
Use our product photographs or packaging artwork
Use our trademarks or business identity
Copy substantial portions of the website

You and Homegrown Hemp submit to the courts of New South Wales and courts entitled to hear appeals from them.

This section does not prevent a consumer from exercising rights that are available under applicable consumer law in another Australian state or territory.
